FERGUSON LAW SETTLES INDUSTRIAL ACCIDENT FOR $7 MILLION
A team of attorneys led by The Ferguson Law Firm’s Paul ‘Chip’ Ferguson has reached a $7,000,000 settlement for a 42-year-old construction worker injured in a 2021 industrial accident. The plaintiff was a pipefitter working a turnaround inside a Pasadena facility when he was struck by a tool that had fallen from an overhead scaffold used by another contractor. The man suffered significant back and hip injuries. The case was pending in Harris County and settled the week prior to trial.
“This case underscores the absolute necessity for safe tool handling procedures inside a petrochemical facility,” Mr. Ferguson said. “It also demonstrates the risk that our working men and women are subjected to when others fail to heed necessary work procedures for overhead work. This was a completely preventable injury had safety been followed. It wasn’t and our client suffered dire consequences.”
Ferguson added, “Our client underwent multiple surgical procedures, amassed several hundred thousand dollars in medical care, and has yet to return to work. It is our hope that this recovery allows him to continue to heal and find a way forward so that he may contribute to society over the rest of his life.”
Ferguson was aided by firm associate Jai Cosey as well as paralegals Ashlie Allen, Melissa Wesolowski and Yulisa Ceja. Ferguson spread the credit around, “This was a tremendous result for this type of case and could not have occurred without a true team effort. Ms. Cosey’s efforts were exceptional and, as always, we benefitted from the “best in the business” work of Ashlie, Melissa and Yulisa. I could not be prouder of our result.”
