FERGUSON LAW CLAIMS $1 MILLION SETTLEMENT IN ASSAULT CASE

 

The Ferguson Law Firm has obtained a $1 million settlement in a case involving the assault of a Southeast Texas man while visiting a Louisiana nightclub.  Firm managing partner, Paul ‘Chip’ Ferguson, and partner Tim Ferguson represented the plaintiffs.

The man was assaulted during an altercation with the club’s bouncer, resulting in a closed head injury.  Chip Ferguson said, “A major issue was whether the club’s insurance policy would or would not apply.  There was a specific exclusion from coverage if the injury was due to an assault.”  The case, which began in Jefferson County’s 60th District Court, moved to federal court when the insurance carrier sought a declaration that there was no coverage.  “We were able to push back and defeat those efforts,” Ferguson said.  “That allowed us to return to state court, obtain a trial date, and, when faced with that, the defendants tendered their entire $1 million policy.”  The case was set for trial for January 2023 and settled shortly before.

“The satisfaction for us is that we were able to maximize our clients’ recovery and obtain the full policy coverage,” Tim Ferguson said.  “Our main objective, in this case and in all cases, is to do the best possible job for the client.  We did that here.  The clients are pleased and, because of that, so are we.”
