Attorney Mark Sparks – Do you take every case
Ferguson Law Firm Attorney Mark Sparks explains the importance of a trial attorney.
That's another misconception people have about lawyers — that we sign up every case and we file every lawsuit. That's absolutely false. I have to turn away a lot of clients; I just did one this morning, because of some of the laws in the state. For example, there's governmental immunity — you can't sue the government for everything. There are some things you can't sue for.
We look at cases, we talk to the client, and we make a determination, based on the facts and the law, whether we can actually help this client. There's no sense in taking a case and filing it when we have no business interest, nor any self-interest, in presenting a frivolous case. Why would we spend money and raise the hopes of a client knowing it's not going to result in anything good, and drive it to a conclusion that's just going to make everyone angry? We wouldn't be in business for very long.
So no — there is a filtering. There is a frank discussion we have with the client early on, to look at the law and look at the facts, and tell them yes or no, whether we think we can help.
