$8.25 MILLION DOLLAR UTV ROLLOVER SETTLEMENT

$8.25 MILLION DOLLAR UTV ROLLOVER SETTLEMENT

The Ferguson Law Firm, LLP of Beaumont, Texas obtained an eight million two hundred fifty thousand dollar ($8,250,000.00) settlement following a UTV rollover that led to the wrongful death of a child and seriously insured the child’s father and sibling.

Attorneys Paul F. “Chip” Ferguson Jr., Managing Partner, Mark Sparks, Partner, Jane S. Leger, Partner, Tripp Jones, Attorney, represented the family in the resulting lawsuit, which was filed after the UTV’s recalled steering malfunctioned causing the UTV to suffer the rollover.

Chip Ferguson, Managing Partner, expressed that the result belied the difficulty of the case, which

“was reviewed and rejected by another local law firm, telling this family it had no case. Fortunately, the family disagreed and so did we. By devoting the time and resources necessary, we were able to obtain justice for the family, a result I am extremely proud of.”

Mr. Jones, in his sixth year with The Ferguson Law Firm and who joined the matter in the midst of its multi-year litigation, voiced that

“nearly ten (10) years after the rollover, eight (8) years of litigation, including, multiple appeals, and on the eve of trial, this family can, at long last, move forward with some measure of justice, even if such earthly sums are forever inadequate to compensate for the grief of the family.”

Echoing the sentiment of Mr. Jones, Mark Sparks, Partner, aired:

It took a litany of experts, at least two dozen depositions taken in two different countries, countless hearings and motions in the trial court, and two appeals all the way to the Texas Supreme Court—but this family finally got the justice, and some sense of closure, they so greatly deserved. Sure, it’s nice to get a quick, big hit with an 18-wheeler settlement you can splash on a billboard, but it’s the final resolution of hard-fought, expensive, and complex cases like this one that mean the world to me. The Ferguson Firm routinely handles difficult, expensive, and complex cases—and we’re honored to have worked on this one for this grieving and injured family.

Jane S. Leger, Partner, commenting conclusively, reported that

“this case was gut-wrenching as are many of the cases we handle. But here knowing a known and admitted safety defect caused the death of a young child and serious injuries to others was something our firm would not turn away from no matter how hard or long fought by the Defendants. I am honored to have been on the team of lawyers our firm assembled to help this family secure resolution.”
